11. DISPUTE RESOLUTION AND ARBITRATION

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. You agree that any dispute arising from or relating to your use of this service shall be resolved through binding arbitration.

You and Pinnacle Nutra Labs agree that any claim or dispute must be filed within one year after it arises or is discovered. Otherwise, the claim is permanently barred.

Both you and Pinnacle Nutra Labs agree to attempt to resolve any dispute informally through good faith negotiation before initiating arbitration. If the parties cannot resolve the dispute informally within 30 days, either party may initiate binding arbitration.

Any arbitration shall be conducted on an individual basis, not as a class action, class arbitration, or representative action. You waive your right to participate in any class action or class arbitration against Pinnacle Nutra Labs. You also waive your right to a jury trial.

Arbitration shall be conducted by a single neutral arbitrator under the American Arbitration Association (AAA) rules. The arbitration shall be conducted virtually unless the parties agree otherwise. Each party shall bear its own costs and attorney’s fees unless the arbitrator awards fees to the prevailing party.

Exception: You may bring a claim in small claims court if the dispute qualifies under your state’s small claims court jurisdictional limits.

The arbitrator shall have authority to award any relief that would be available in court under applicable law. The arbitration decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

12. CONSENT TO CONTACT

You expressly consent to Pinnacle Nutra Labs and our representatives contacting you at the phone number, email address, and other contact information you provide through any means, including SMS text message, phone calls, emails, and postal mail. You acknowledge and agree that we may use prerecorded messages, automatic telephone dialing systems, and artificial intelligence or other automated technology to contact you.

You waive any objections, claims, or restrictions related to being contacted by us. You understand that your carrier may charge standard rates for SMS messages and data usage.

13. DATA HANDLING AND RETENTION

We will retain your submission information for the purpose of responding to your inquiry, maintaining business records, and complying with applicable laws. We retain information for a minimum of three years from the date of submission unless a longer retention period is required by law.

You may request deletion of your personal information by emailing sales@pinnaclenutralabs.com with the subject line “Data Deletion Request.” We will respond to deletion requests within 30 days. However, we may retain information longer if required by law, if there is an active business relationship, or if litigation or disputes are pending.

15. TERMINATION

We may terminate your ability to use this service immediately if we determine that you have violated these Terms of Service, submitted fraudulent information, or engaged in harmful or illegal conduct. Termination is effective immediately, and you will no longer be permitted to submit inquiries through our service.

The provisions of these Terms regarding liability limitations, indemnification, arbitration, and dispute resolution shall survive any termination.

16. ENTIRE AGREEMENT
